ABB Optical Group Canada, Inc, and/or its affiliates (collectively, "ABB," "our," or "we") operates its website available at abboptical.ca (the “Website”). ABB values and respects the privacy of its customers and visitors. The purpose of this Privacy Policy is to describe the manner in which we collect, use, disclose and otherwise process personal information when you visit or use our Website, or when you otherwise interact with us. This Privacy Policy also describes the choices you can make about our use of your information.

COLLECTION AND USE OF PERSONAL INFORMATION

In the course of fulfilling lens orders and deliveries for eye care professionals, we collect and use personal information for the following purposes:

Online Account Creation: To place an order through the Website, you will be required to open an online account. We collect information about you and your practice in order to create and administer your online account, such as your first and last name, email address, banking information, practice mailing address and phone number, account number and a password that you create. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages). We also collect information as part of your credit application, if applicable, including your business and personal credit history and license or registration number.

Order Fulfillment: When you place an order for lenses through the Website, we collect personal information about your patients including their first and last name, prescription information, order, and shipping address (if you choose to ship the lenses directly to your patient) and maintain a record of your order history. You are responsible for ensuring that you have obtained all necessary consents and provided all necessary notices to provide this information to us, and to enable us to process the patient data.

Marketing Communications: We may send you our newsletter, or other marketing or promotional information regarding our products and services, in which case we may collect and use personal information about you and your practice, including your name, email address, practice location and products that you may have purchased from us in order to provide relevant communications. You can opt-out of receiving these communications by clicking on the unsubscribe link included at the bottom of the email or by contacting us as set out under “How to Contact Us” below. Please note that if you unsubscribe, you may continue to receive certain transactional or account-related communications from us.

Surveys/Analytics: From time to time, we may offer you the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, de-identified form. We use this information to help us understand our users and to enhance our Services.

Customer Service: When you contact us with a comment, question or complaint, you may be asked for information that identifies you (such as your name, address and a phone number) along with additional information we need to help us promptly answer your question or respond to your comment or complaint. We may retain this information to assist you in the future and to improve our customer service and product and service offerings.

Call Recording: We may monitor and record our telephone conversations with you for training and quality assurance purposes. You will be provided with a notice at the beginning of any call that is being recorded. If you do not wish to have your call recorded, please let us know.

SHARING OF PERSONAL INFORMATION

We will not disclose, trade, rent, sell, or otherwise transfer your personal information, without your consent, except as otherwise set out herein.

Service Providers: Your personal information may be transferred (or otherwise made available) to our affiliates and other third parties who provide services on our behalf. We use service providers to manage and process your information, for example, providers of payment processing software, hosting providers, shipping partners, and marketing and advertising service providers. Your personal information may be maintained and processed by ABB and its affiliates and third-party service providers in the US, Canada, or other jurisdictions. In the event personal information is transferred to the US or other foreign jurisdiction, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with those laws. Our service providers are given the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes.

Business Partners: We may share your personal information with our business partners, including product manufacturers and promotional business partners who help us run joint promotions or who provide a product or service in partnership or collaboration with us.

Legal/Compliance: ABB and its Canadian, US and other service providers may disclose your personal information in response to a search warrant or other legally valid inquiry or order (which may include lawful access by Canadian, US or other foreign governmental authorities, courts or law enforcement agencies), to other organizations in the case of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud or as otherwise required or permitted by applicable Canadian, US or other law. Your personal information may also be disclosed where necessary for the establishment, exercise, or defense of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.

Sale of Business: Personal information may be transferred as an asset in connection with a prospective or completed merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of ABB or as part of a corporate reorganization or stock sale or other change in corporate control.

With your consent, we may also share your personal information with other third parties.

INTEREST-BASED ADVERTISING

If we receive a request from a patient to access or update personal information, we will direct that individual to the relevant customer.

We may update or modify this Privacy Policy at any time, by posting the amended version including the effective date of the updated version. We may also notify you of any material changes to this Privacy Policy through an alert on our website and/or by email.
